1. Acceptance of Terms

By downloading, installing, or using the Elseware mobile application ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the App.

2. Description of Service

Elseware is an ambient sound mixer for iPhone that allows users to blend music, soundscapes, and place-based audio presets to create custom listening experiences. The App is designed for use on iPhone only and is not supported on iPad, iPod touch, or any other device. The App is available with a free tier and an optional paid subscription ("Elseware Pro").

3. Free and Pro Tiers

• Free tier: Users may mix up to 3 simultaneous sounds from the available library.
• Elseware Pro: Unlocks unlimited simultaneous sounds and the ability to save custom mixes. Pro is available as an in-app purchase subscription.

4. Subscriptions and Payments

Elseware Pro subscriptions are processed through Apple's App Store. All billing, renewals, and cancellations are managed by Apple in accordance with their terms. We do not directly process or store your payment card information. We retain a record of your subscription status to provide Pro features.

5. User Conduct

You agree to use the App only for its intended purpose. You may not:

• Reverse engineer, decompile, or disassemble the App
• Redistribute, sublicense, or resell any part of the App or its content
• Use the App in any way that violates applicable law

6. Intellectual Property

All audio content, design, code, and branding within Elseware are owned by or licensed to us. You may not reproduce, distribute, or create derivative works from any part of the App without written permission.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

9. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated terms. We encourage you to review this page periodically.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice.
